OBTAINING VISA WITHOUT LEAVING VIETNAM.
This is a new regulation of Law on amendment to some articles of the Law on entry, exit, transit and residence of foreigner in Vietnam which takes effect as from 1 July 2020. Accordingly, the new law allows the foreigners to be transferred visas purpose without leaving Vietnam if the foreigner meets one of the following conditions:
a) Obtain documents proving that the foreigner is the investor or the representative of foreign organization;
b) Obtain documents proving that the foreigner is in relationship of parents, spouse, children with the persons invited or sponsored;
c) Is invited or sponsored by an organization or individual for working and obtain the Work Permit or the Certificate of exempt from Work Permit in accordance with regulations on labor; and
d) Use electronic visas to entry into Vietnam and obtain the Work Permit or the Certificate of exempt from Work Permit in accordance with regulations on labor.
In the light of above, these regulation are completely in accordance with actual situations as well as create favorable conditions for foreigners to continue to stay in Vietnam that will not take time and cost for them to exit or entry.
Moreover, hereinafter are some notable points for your reference:
1. Temporary Resident Card (TRC)
The foreigner will be allowed to issue the TRC if he/she is issued with LV1, LV2, LS, ĐT1, ĐT2, ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT visas. Moreover, the TRC is only issued when foreign investors and the representative of foreign organization are issued visa to invest in Vietnam with the investment capital of at least from VND 3,000,000,000.
2. The foreigner can be entitled to visa–free entry when entering into the coastal economic zone based on Government’s decision, providing that it meets the following conditions:
a) Having an international airport;
b) Having an private space;
c) Having definite geographical boundaries;
d) Separation from land;
e) Suitable with Economic - Society development policy; and
f) Without prejudice to national defense, national security, social order and safety of Vietnam.
